This Privacy Policy of the website www.infimeo.com (including all its domains such as www.infimeo.com and its subpages; hereinafter referred to as the “Website”, and these privacy rules as the “Policy”) govern your access to the website infimeo.com, operated by FUERGY Industries j. s. a., with its registered office at Pribinova 34, 821 09 Bratislava – Staré Mesto, Slovak Republic, Company ID No.: 52 083 799, registered in the Business Register of the City Court Bratislava III, Section: Sja, Insert No.: 65/B (hereinafter referred to as “FUERGY Industries j. s. a.”, “we”, “us” or “our”, as applicable).

By accessing the Website and/or by checking the box “I agree with the Privacy Policy”, you confirm that you have read, understood, agree with, and undertake to comply with this Policy. This Policy applies to natural persons as well as to legal entities, including business companies and other entities. This Privacy Policy reflects Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation, “GDPR”), as well as Slovak Act No. 18/2018 Coll. on the Protection of Personal Data and on amendments to certain acts, as amended (the “Act”).
Where this Policy does not regulate certain rights or obligations, or regulates them differently from the GDPR and/or the Act, the relevant provisions of the GDPR and/or the Act shall apply regardless of the content or absence of provisions in this Policy.

Within the “Contact” form and/or other forms available on the Website, we collect data such as the first name, last name, email address, and telephone number of data subjects, as well as any additional information they may provide in the “Contact” form and/or other forms published on the Website, in order to enable us to send such data subjects marketing communications, in particular, but not exclusively, informational, educational, and promotional marketing materials, newsletters, and emails of FUERGY.

Recipients of your personal data may include: entities to whom FUERGY is legally required to provide your personal data, entities cooperating with FUERGY for administrative and technical support, entities cooperating with FUERGY to support, manage, and develop the information system, entities cooperating with FUERGY for external audits, the company providing Microsoft Office 365, including Outlook, and professional consultants and advisors bound by statutory and/or contractual confidentiality obligations.

Personal data may also be processed for other purposes, for example, in connection with the exercise of the data subject’s rights under the GDPR, in litigation or non-litigation proceedings, if the personal data are requested by public authorities, in the case of suspected or actual breaches of personal data protection and for the purposes of their investigation, for senders and recipients of correspondence, and for other persons mentioned in the correspondence.

Transfer to other countries

Your personal data are transferred, processed, and stored on servers located in the Slovak Republic. We may outsource data processing to third parties located in countries other than your home country, or share data with them. To provide you with access to the website, you acknowledge and accept that your personal data may be processed, transferred, and stored in other countries where you may not have the same rights as under local law.

Your personal data will not be transferred to countries that do not ensure an adequate level of protection (hereinafter referred to as ‘third countries’).

How we keep your data secure

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of all personal data we process. Despite our security measures and efforts to safeguard your information, the complete security of any electronic transmission over the Internet or any information storage technology cannot be guaranteed, and therefore we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not bypass our security and unlawfully collect, access, steal, or alter your data. Although we will do everything within our power to protect your personal data, the transfer of personal data to and from our services is at your own risk. Rights of Data Subjects

f) the personal data were collected in connection with the offer of information society services.

The exercise of the right to erasure shall be subject to the relevant limitations laid down by applicable law.

The data subject has the right to request the restriction of processing if:
a) the accuracy of the personal data is contested, for a period allowing us to verify the accuracy of the personal data;
b) the processing is unlawful and the data subject opposes the erasure of the personal data and requests restriction of their use instead;
c) the personal data are no longer necessary for the purposes of processing, but the data subject requires them for the establishment, exercise, or defense of legal claims;
d) the data subject has objected to processing, pending verification of whether our legitimate grounds override the legitimate grounds of the data subject.

The data subject has the right to receive the personal data concerning them which they have provided to us and to transfer such data to another controller, where technically feasible, if the processing is based on consent or on a contract and the processing is carried out by automated means.

The data subject has the right to object at any time, on grounds relating to their particular situation, to the processing of personal data concerning them that is based on the applicable legal provisions, including profiling based on those provisions.

Where personal data are processed for direct marketing purposes, the data subject has the right to object at any time to the processing of personal data concerning them for such marketing purposes, including profiling to the extent that it is related to such direct marketing.

Subject to applicable legal limitations provided by law, the data subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them.

Withdrawal of Consent:

If we process your personal data based on the consent you have provided, you have the right to withdraw your consent at any time. You may withdraw your consent at any time by contacting us using the contact details provided in these Privacy Policy provisions.

Please note, however, that such withdrawal will not affect the lawfulness of processing carried out before the withdrawal, nor will it affect the processing of your personal data carried out on other legal grounds than consent.
